1. Introduction

Welcome to mapdap ("we," "our," or "us"). By accessing or using our mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

mapdap is operated by mapdap OÜ, a private limited company (osaühing) registered in Estonia under Registry Code 17400755, with registered address at Harju maakond, Tallinn, Kesklinna linnaosa, Tornimäe tn 5, 10145.

2. Eligibility & Parental Advisory

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms in your jurisdiction. We may, at our discretion, decline to provide the Service or terminate accounts where we believe these requirements are not met.

Parental Advisory: mapdap allows users to connect and may facilitate interaction with people they do not previously know, including in the real world. We strongly advise parents and guardians to monitor minors' use of the Service and to discuss online and offline safety with them.

mapdap is a platform that enables connection between users. We do not conduct background checks on users and we are not responsible for the conduct of any user on or off the Service. You agree to use caution in all interactions with other users, and you assume all risk associated with communicating with, meeting, or otherwise interacting with other users.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account, and for ensuring that your use of the Service complies with all laws applicable to you, including in any jurisdiction where you access or use the Service.

3. Accounts & Phone Verification

To access certain features of the Service, you must create an account and verify a phone number. You agree to provide accurate, current, and complete information when registering and to keep that information up to date. We may, at our discretion, require additional verification at any time.

You are responsible for safeguarding your account credentials and for any activities or actions taken under your account. You must promptly notify us of any unauthorized use of your account or any other suspected breach of security. You may not share your account, sell access to it, or transfer it to another person.

Posting vibes, leaving comments, and taking part in chats require a verified phone number, even if you sign in using email or another method. We use phone verification to support trust and safety on the Service and to assist us in handling reports and lawful requests.

4. User Content

The Service allows you to post text, photos, videos, comments, location data, chat messages, and other content ("User Content"). You retain ownership of your User Content. By submitting User Content to the Service, you grant mapdap a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for technical purposes such as resizing, transcoding, and moderation), distribute, and publicly display your User Content solely as needed to operate, provide, secure, and improve the Service. This license ends when you delete the User Content or your account, except to the extent we need to retain a copy for backups, legal claims, safety, or to comply with applicable law.

You are solely responsible for your User Content and for the consequences of posting it. You represent and warrant that you have all rights necessary to grant the license above and that your User Content does not infringe the rights of any third party or violate any law applicable to you.

Zero Tolerance for Objectionable Content and Abusive Users. mapdap operates a zero-tolerance policy for objectionable content and for users who engage in abusive behavior. The Service provides in-app tools to filter, flag, block, and report content and other users. When a report is submitted through these mechanisms, we will review and act on it within 24 hours of receipt — which may include removing the content, restricting its visibility, warning the responsible account, or suspending or terminating the account in accordance with Section 8 (Suspension & Termination). We reserve the right to act sooner where a report involves an imminent threat to safety or a clear violation of these Terms, and to refer reports to law-enforcement authorities where appropriate.

5. Prohibited Activities & Content

You agree not to use the Service to (and not to allow others to):

  • Violate any law, regulation, or order applicable to you, including in any jurisdiction where you access or use the Service.
  • Post or share content that threatens national security, public order, public morality, or community safety; that incites violence, terrorism, or hatred; or that promotes, glorifies, or facilitates harm.
  • Post or share images, videos, locations, or other information identifying military, police, security, or critical-infrastructure sites or operations.
  • Post or share rumors, false information, or other content that may disturb public order or harm the reputation of others.
  • Post sexually explicit content; any content that sexualizes, endangers, or exploits minors; non-consensual intimate imagery; or content that promotes self-harm.
  • Harass, bully, threaten, intimidate, dox, stalk, or impersonate any person, or misrepresent your affiliation with any person or organization.
  • Post content that infringes the intellectual property, privacy, publicity, or other rights of any person.
  • Engage in spam, scams, phishing, fraud, deceptive practices, pyramid or similar schemes, or unauthorized commercial solicitation.
  • Promote, sell, or facilitate the sale of regulated goods (such as alcohol, tobacco, gambling, drugs, weapons, or financial products) where prohibited or restricted by applicable law.
  • Interfere with or disrupt the Service or any networks or systems connected to the Service, including by introducing malware, scraping, reverse-engineering, or attempting to gain unauthorized access.
  • Use the Service to coordinate, plan, or facilitate any unlawful activity or any meeting with or contact involving a minor outside of lawful, supervised contexts.
  • Use automated means (such as bots or crawlers) to access the Service except where we expressly permit it.

6. Intellectual Property

The Service and all of its original content (other than User Content), features, and functionality, including the mapdap name and logo, are and will remain the exclusive property of mapdap OÜ and its licensors, and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property other than the limited right to use the Service in accordance with these Terms.

7. Subscriptions & Payments

mapdap offers optional paid subscriptions that unlock additional premium features of the Service:

  • mapdap Premium (Monthly): $9.99 per month.
  • mapdap Founding Member (Annual): $49.99 per year. Annual subscribers also receive an exclusive Founding Member badge.

Both plans give you access to the same set of premium perks; the only difference between them is the Founding Member badge granted to annual subscribers.

Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan. You can manage and cancel your subscription in your Apple ID account settings after purchase.

Subscriptions are processed and managed through the Apple App Store and are subject to Apple's terms in addition to these Terms. We do not control App Store pricing localization, currency conversion, or applicable taxes, which may differ by region.

Except where required by applicable law, all payments are non-refundable. Refund requests for App Store purchases must be made directly to Apple.

8. Suspension & Termination

We may suspend, restrict, or terminate your access to the Service, remove User Content, or close your account at any time, with or without notice, where we reasonably believe you have violated these Terms, where required by law, where we believe it is necessary to protect the safety, security, or rights of mapdap, our users, or others, or where continued provision of the Service is no longer commercially or operationally feasible. Where lawful and appropriate, we will explain the reason for an enforcement action and offer a way to contact us. You may stop using the Service and delete your account at any time.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, FEATURES, AND FUNCTIONALITY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT VERIFY, ENDORSE, OR ACCEPT RESPONSIBILITY FOR USER CONTENT OR THE CONDUCT OF ANY USER, AND WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR SAFETY OF ANY INFORMATION, CONTENT, OR INTERACTION ON OR THROUGH THE SERVICE.

10. Assumption of Risk

You acknowledge that interacting with other people — online or offline — carries inherent risks, and that any decision to communicate with, meet, or otherwise engage with another user is made at your own risk. mapdap does not conduct background checks, identity verification beyond a phone number, or screening of users. You are solely responsible for taking appropriate precautions when interacting with other users, including when meeting them in person. You agree that mapdap has no obligation to monitor user interactions and is not a party to any communications between users.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MAPDAP OÜ OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; ANY USER CONTENT OR THE CONDUCT OF ANY USER; OR ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MAPDAP IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

WE ARE NOT RESPONSIBLE FOR THE CONDUCT, CONTENT, INFORMATION, OR ACTIONS (ONLINE OR OFFLINE) OF ANY USER OR THIRD PARTY, AND YOU RELEASE US, OUR AFFILIATES, AND OUR PERSONNEL FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY SUCH DISPUTE OR INTERACTION.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the limitations above will apply to the maximum extent permitted by applicable law.

12. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless mapdap OÜ and its directors, officers, employees, agents, partners, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content or any content you submit, post, or transmit through the Service; (c) your violation of these Terms or any applicable law; (d) your violation of any rights of another person or entity; or (e) any dispute or interaction between you and any other user or third party.

13. Compliance with Law & Lawful Requests

You acknowledge and agree that mapdap will respond to valid legal process and lawful requests from competent authorities, including in any jurisdiction where you access or use the Service, and may preserve, access, use, and disclose your account information, User Content, location data, communications, device information, and other related data where we believe in good faith that doing so is required by applicable law, necessary to comply with legal process, or appropriate to protect the rights, safety, or property of mapdap, our users, or the public. We may also remove or restrict access to content that we believe, in good faith, may violate applicable law or these Terms. You are solely responsible for ensuring that your User Content and use of the Service comply with all laws applicable to you.

14. Governing Law & Dispute Resolution

These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws principles. Subject to any mandatory protections of consumer law that apply to you in your country of habitual residence, the courts of Tallinn, Estonia will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before initiating any formal proceeding, you agree to first contact us at support@mapdap.com to attempt to resolve the dispute informally. Any claim must be brought within one (1) year after it arises, except where applicable law prohibits a shorter limitation period.

15. General Provisions

These Terms, together with our Privacy Policy and any other policies referenced in them, constitute the entire agreement between you and mapdap regarding the Service and supersede any prior agreements. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision will not waive our right to enforce it later. You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent; we may assign these Terms freely. We will not be liable for any failure or delay in performing our obligations where the failure or delay results from causes beyond our reasonable control. Notices to you may be provided through the Service or by email to the address associated with your account.

16. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will provide reasonable notice (for example, by updating the date at the top of these Terms or by other means we consider appropriate). Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
